5:06 pm

official. his novel theory would immunize former presidents for criminal liability for bribery, treason, sedition, murder, and here conspiring to use fraud to overturn the results of an election and perpetuate himself in power. >> the supreme court justices acknowledged the magnitude of the hearing, and for more than 2.5 hours wednesday, they grilled attorneys on both sides. >> do you differentiate between the president acting as president and the president acting as candidate? >> trump's attorney said immunity should not cover private acts, but should cover official acts and the organization of alternate slates of electors. was trump taking official action? justice ketanji brown jackson asked about the dangers of immunity. >> the potential for criminal liability is taken off the table . wouldn't there be a significant risk that future presidents would be emboldened to commit crimes with abandon while they're in office? >> justice elena kagan

5:08 pm

second option could be that they accept it, and that would put a complete stop on the case. and then another option could be that they say we need to have more clarity. let's send it down to a lower court. but then of course, that could delay the trial past the november election . and if trump is elected, he could basically tell the doj to stop the case and stop the prosecution. >> okay. so it can play out a number of different ways. all right. we'll be watching. gianna. thank you. >> meantime, the former president was back in a new york courtroom today. he's on trial accused of falsifying business records in relation to alleged hush money payments to an adult film actress in the run up to the 2016 presidential election, when the former publisher of the national enquirer talked about the agreement he had with mr. trump to buy and kill negative stories during the 2016 campaign, david pecker said, by the time the stormy daniels story started shopping around, he'd already paid for two catch and kill deals, and he says he wasn't interested in making a third. mr. mr. trump has pleaded not guilty and says he plans to

5:46 pm

them know that his life is about to change forever. and then there's some celebration on both ends. according to lynch, the 40 niners have given first round grades to 22 players, so they are hoping that one of those is available when they make their first selection later today. but if not, maybe they trade down and acquire more picks. and then there are the gold helmet players, as they call them, lynch says. these are the players who in their eyes are the cream of the crop, the best of the best in terms of what the niners are looking for. >> i believe we were about 16 gold helmets and we like keeping that standard high. you always want to give more. let's let's stick to our standards because the reason our hit rate is high is because it is such a high standard. we do well with those guys because it takes into account everything we believe in. you know, that's that's talent, that's spirit. and you know, playing like a 40 niner back to throw. >> okay. another thing we're keeping a close eye on is whether or not wide receiver

5:47 pm

brandon aiyuk will still be a niner after today. aiyuk is in the final year of his contract. it's going to pay him $14 million. that's a lot of money. but he is looking for a multi year deal for a whole lot more than that. and he's staying away from the 40 niners practice facility from where we are now presumably until he gets what he wants which is paid or traded. there's a report out today that the niners may be interested in trading either aiyuk or deebo samuel. if they can move up into the top ten. it's a very deep draft for receivers and if that's going to happen, it's going to have to happen soon. so so christian and julie, that's the scene here. we're going to come back in about an hour and we'll find out if the 40 niners have made any moves, if they've drafted anybody made any trades, and if not, we're also going to look at when brock purdy was drafted, because we all remember that moment and how his life was changed forever. yeah i mean, a lot can happen between now and the next couple of days.

5:48 pm

>> a lot of high stress, a lot of moving and shaking going around. so they have ten picks. the 40 niners have ten picks. jason i'm looking right now. they have one in the first round. second round third round. then they have three in the fourth round. so they're heavy in the later rounds. what's your sense on what do they need the most. where do you think they're going to go here potentially if they do pick in the number 31 spot where are they weak. and where are they going to try to fill? >> you know, it's funny, i was just in the in the media room talking to mike silver and a couple other guys in there. nobody knows when you're picking top three, there's a pretty good idea or top five when you're 31st overall, the speculation runs from an offensive tackle. maybe someone that could end up replacing trent williams to a wide receiver to an edge rusher, because the 40 niners seem to draft a lot of edge rushers, pass rushers in the first round. so nobody really knows. and i could, you know, we could throw out ten names and they could take somebody totally different. so that's the beauty of the draft. and in fact, nobody will

5:49 pm

even remember the name that i tell him. if i were to tell him a name because they'd probably take somebody else and i'd be exonerated anyway. so. all right. >> well, we are all it's very exciting. we're all watching and waiting to see how it all shakes out, and we'll be checking in with you a little bit later. jason. thank you. >> former giants manager dusty baker has won the baseball digest lifetime achievement award. the annual award recognizes an individual whose career has been spent in or around major league baseball, and who has had made significant contributions to the game. baker played 19 seasons in the big leagues and managed the giants for ten years. in 2022, he won the world series as the manager of the houston astros. he's currently in the giants special advisor to baseball operations. baker released a statement today saying, quote, receiving this award is a tremendous honor, well deserved. >> well, this cooler pattern wants to stick around, at least for one more day. and right now,

5:52 pm

once again. maybe some drizzle or some light rain, especially near the coast or the coastal hills. tomorrow morning. this is what we'll be watching into tomorrow afternoon. out towards solano county, the inland east bay. there's a chance of a few showers could rapidly develop, move in and move out. so you probably see those big cloud buildups tomorrow afternoon and the weekend. good news. you want to get outside. it will be dry and a bit of a warming trend headed our way, especially by sunday. so some clouds in the morning, gusty winds in the afternoon, hours and temperatures mainly in the 60s. your weekend forecast, as we talked about, we're going to clear out the clouds, especially by sunday, a warming trend that will begin. and it should continue into next week. in fact, by tuesday, the warmest locations in the inland could be back up to 80 degrees. so from cool conditions to warm conditions, it's all happening over the next several days. >> something for everybody. thanks a lot mark, i appreciate it. are changes coming for those who fly southwest when it comes to seating preferences? we'll tell you why the airline is looking at the idea. >> and coming up tonight at six, hundreds of thousands of dollars

last quarter, the commerce department says the economy grew 1.6% in the first quarter of 2024. that's the slowest pace in nearly two years and well below economists estimates. but the commerce department says the measure of inflation, called the personal consumption index, surged 3.7% in the first quarter. that is an index that's closely watched by the federal reserve. >> so when you have inflation higher than growth, that's a recipe for what's called stagflation. that's what's scaring people. probably shouldn't worry about it too much right now, but i think that was underlying the concern on wall street today. >> mcbride said that the underlying economy remains strong, with low unemployment, rising wages and consumer who are continuing to spend money

5:57 pm

despite inflation. well, the dow was down 375 points, a drop of about 1. the nasdaq off by 100 points, the s&p dropping 23 points. shares of meta, the parent company of facebook, were down more than 10% over concerns over whether its big investments in ai will pay off. >> open seating has long been a feature on southwest airlines, but that could change in an interview after reporting weaker than expected revenue, southwest ceo said the airline is looking at new ways to boost revenue and that could include, among other things, charging passengers to select seats ahead of time or different ways of paying to board the plane. earlier, the airline says it has made it hasn't made any decisions, just yet, though it also said that it is not considering charging for checked bags. well, people in the bay area and across the country are running into challenges in finding veterinarians and now a new study suggests the shortage is only getting worse.

5:58 pm

>> yeah, it's a problem in both big cities and in rural communities. fox's sunny tsai reports from ventura county. it's common these days to schedule an appointment for your pet and need to wait weeks, if not months, for them to get seen. >> this applies to both general and urgent care workers here at the humane society of ventura county. tell me. they tried to book their appointments to max capacity each day to help alleviate this problem, especially since covid, i've never seen emergency rooms have to turn people away. and in these cases, they don't always have a veterinarian on staff in an emergency room because of shortages, 47 states are facing some sort of veterinarian shortage, and the high cost of vet school doesn't help the case. >> most vets are graduating with an average of about $160,000 in student loans, and then the shortage also goes into the fact that veterinarians, oftentimes, once they graduate, they want to start repaying those loans. >> and so they're going to look for more lucrative jobs in larger cities and things like that. working at municipal shelters, nonprofits, vets are

5:59 pm

not going to be nearly as lucrative as a private practice. >> doctor sisk was the only vet at the humane society of ventura county for several years until last fall. >> last fall, the board of directors said, you know what we need to be a bigger part of this solution, so let's hire an additional veterinarian if we can. >> the shelter is also sending workers into the community to offer low cost vaccinations. >> when you talk about barriers to access to veterinary care, you're not just talking about the first thing that comes to mind, which is finance, which is very important. but you're also talking about geography. and so while we are close to some large populations, we're a little bit further from others. >> the humane society also says teaching the community to be a part of the solution by getting their pets spayed and neutered will also help lower the demand for vet services in ojai, california. sunny sky fox news this is ktvu, fox two news at six eight inmates in san francisco county jails are facing charges accused of attacking deputies. >> and now what led to the

environment leading to these attacks is being debated. >> absolute confidence in all of our staff, not just our deputies, but also our professional staff, our medical staff, everyone's in this together to make sure we keep it a safe place. >> the san francisco sheriff says nine deputies were attacked over the past three weeks, and some of them suffered serious injuries. hello again everyone, i'm julie julie haener and i'm alex savage, the san francisco sheriff's association is blaming understaffing and mandatory overtime for those assaults. >> ktvu is crystal bailey joining us live tonight from san francisco after speaking with the sheriff about the union's complaints, crystal. >> well, the union says that these attacks on the deputies are a direct result of mandatory overtime. but sheriff miyamoto says that even though they're only at 73% staffing right now, he doesn't think that's the issue. he says the jails are overpopulated, partially because of an uptick in arrests surrounding drugs. but he says he's
